Well it shouldnt be, cause as you say, has nothing to do with the Nazis.

The danish brewery Carlsberg has the swastika in several places too, and back in the day, the swastika logo was even used on the beers themself (thats stopped during and after WWII, cause people stopped buying the beer, due to the swastika on there). But this dates long before the Nazis made their entrance, and tainted this ancient religious symbol.

 

These fellas have been guarding the entrance to the Carlsberg brewery since 1901.

as long as it isn't forbidden in your country i see no problem.

for me - i wouldn't dare to post some pics with swasticas, since they're forbidden in austria ;)

 

Is that in any shape and form, as in the above elephants, when it has absolutely nothing to do with the Nazis?

Austria strictly prohibits the public display and/or proliferation of all insignia/symbols, emblems, uniforms (full or partial), flags, etc., clearly associated with the National Socialist German Workers Party (NSDAP, commonly known as the Nazi Party). There are legal exceptions for works of art (including books, films, theatre performances, computer games, and educational/memorial public exhibitions, etc.), these however do not apply if the respective work promotes National Socialism (as this is generally prohibited in Austria). The law has been amended to include commonly recognized replacements or slightly modified depictions of Nazi symbols. Violations of the Badges Act 1960 (Abzeichengesetz 1960), which prohibits the public display of Nazi symbols, are punishable by up to € 4000.- fine and up to 1 month imprisonment. However, if the violation is deemed an attempt to promote National Socialism, the Prohibition Act 1947 (Verbotsgesetz 1947) is applied, which allows for up to 10 years imprisonment.

 

Trading medals, uniforms or other memorabilia however isn't illegal in Austria.

Regardless of historic accuracy, we don’t want DCS under a media scrutiny and persecution because someone has misinterpreted a video that contains a swastika.

So if I post a screenshot of bf109 with finnish swastika, I'm not banned?

 

in this case i'd see it as "computer game" resembling a historical correct BF109.

 

i see it the same way, denying our past will not help the future generations, but you have to avoid using nazi symbols as "cool signs"

 

for austria i cannot tell if there will be a difference if you put on a swastica on a wall and call it an inka or aztec symbol ... you will probably be fined or worse here since this symbol is banned here

I'm curious about the laws on this in Germany and Austria. Do they legally differentiate between the Nazi Hakenkreuz and the non-Nazi swastika? Or is it a blanket ban on anything that looks like the Nazi Hakenkreuz?

No, the german law doesn't differentiate between different types of swastika. The swastika itself (among others) is a forbidden symbol and is not allowed. There is an exception from that rule though that allows its use for the purposes of art, science and education.

What you say is not quite accurate. The laws haven't changed. What has changed is the interpretation of the law by the federal institutions that are responsible for rating video games in germany. In the past they did not accept games with swastikas or other symbols in them that are prohibited by our constitution. That interpretation was beeing considered wrong for quite a while, because our constitution makes an exception from that rule for the use of these symbols for art, science and education, as long as the ideology behind the symbol is not beeing glorified. This is why it is usally no problem for movies to have swastikas in them in Germany, as they are considered to be art. The rating agency has now changed its interpretation of the law now, to consider this exception for video games too, as they are also considered as art by many.

IANAL but as far as i can tell, the Austrian law is more focused on banning activities that aim to marginalize or justify the actions and political views of the NSDAP and other Nazi organisations or reestablish their ideas.

 

 

There is a ban on public exposition of insignia that belong to organisations banned under the Verbotsgesetz. It's allowed to show the symbols in print, film and on stage under the condition that the body of thought they represent is not glorified. I can't really tell if this is extended to games.

 

 

This would lead me to think that legally there would not be an issue displaying a swastika if it is apparent that it is not in a national socialist context. People in Austria however are on the one hand rather oblivious regarding other uses of the swastika (like Indian culture) and on the other hand heavily sensitized so a public display of any swastika is certain to cause disconcertment.

Good, fast, cheap. Choose any two.

Exactly, which is why the german law makes exceptions that allows the use of these symbols for the purposes of art (e.g. in movies), science (social science especially) and especially education. The general purpose of banning these symbols is to prohibit its use for glorification of the nazi ideology by todays neo nazis and the like.

Currently something is happening in New Zealand and through out the world that is in fact much worse and on a much larger scale than the Nazi Germany treatment of Jewish people. In the near future the ones responsible will be executed by their own sword(which is hideous-very slow way to die). And then from that moment onwards it will never happen ever again. The people responsible are witches and wiccans, and I'm their executioner "Yorky"(the one who's name should never be mentioned lol). So its very Sodom and Gomorrah but instead of wiping them all out straight away I have to be patient.:gun_smilie:
