Hallo, Ich spiele dcs in Italien aber ich nitch bin in Deutschland leben as es ist die erste zeit.

 

Entuschuldigung fur meine fehler as es ist ein woche ich bin leben in Deutschland.

Ich bin a viel tolerant and good person und ich. sorry i will speak in english as it is easier.

 

I don't want to break the laws and good common sense playing DCS in germany and videogames in general.

 

So i ask:

1. is playing in the Burning sky server illegal in Deuschland? as i see sometime some graphic simbols on the planes like simbol that was used a lot of time ago and are illegal in german legislation. Since i am truly a good man and i don't want to break the law or hurt the common sense, can you please help me understand this?

2. i don't want to break the law are you guys using a paint-skin for planes patch for flying ww2 deutsch planes and covering such imaginery?

 

3. is violence in videogames banned in germany? for example what happens if i bought a game in italy like 'killijng floor 2' and i play in germany am i breaking the law?

 

4. is downloading mods legal in germany?

 

sorry i'm very sorry for these question that may sound stupid but i truly don't want to break the law as i live a quiet life and i want to play dcs.

You can not buy any game in Germany, which have svastica symbols! But you can play it!

 

As you play with a MOD, you are the only person who will see the symbols (until another player has the same MOD on the multiplayer server).

 

You say, you want to play 'Killing Floor 2', i am not familiar with this game, but you could have problems to activate such a game in Germany (if it is forbidden here), because of a region lock!

1 & 2. you are fine, the law has an extra exception for the swastika/nazi stuff, for everything to do with art. Art is very protected in germany. There is one court case where a neo nazi build a very offensive game, and the courts decided that video games are not protected like common art. (This was in the 90ies I believe, so perceptions indeed have changed by now)

 

This law is only for the publishers etc. not for you as consumer. On the law itself, it would probably fall in court, with a very high chance, because Video games are promoted and sponsored as art by the german state.

 

The only reason this has not happened yet, is because major publisher simply are too afraid of initial sale losses after first release in germany. Remember such court cases can take many years.

 

3. No it's not. It's a little complicated, but basically very violent games simply can only be sold 'under the counter' but it's legal. They just can't put them on display.

 

4. No you are good.

 

In german law (as I understand it, not a lawyer!) you can't really get into trouble for downloading stuff. (Major exception would be child pornography, bomb building instructions etc.) But even than it's not the downloading part but the owning it on your computer.

I will also continue in english to answer your questions:

 

1) No, there are no laws about playing on certain servers. You can go and play on the Burning Sky server without problems.

 

2) Using such re-paints is totally fine as well. The german law regarding forbidden symbols is only for selling products on the market, so game developers have to be concerned about it, but not us players. Showing such symbols in the public (e.g. on the street) is generally not legal in Germany, so don't do that, but it's no problem if you use them on historic aircraft paints in DCS.

 

3) No, violence in video games is not banned at all. We have the USK, which is the institution that is rating all video games regarding their violence levels (and other things) and approves them for certain ages (children, teens, adults). Some games that are too violent (or include forbidden symbols) recieve no rating and are either banned from beeing promoted or banned from beeing sold on the market at all (happens very very very rarely). But again, this only concerns the game developers and publishers, not us players. Killing Floor 2 is rated "18+", so you can go ahead and buy it if you're 18 years or older and play it as you like.

 

4) No, not at all. It is totally legal to do so.

As others said already the legal problem with symbols and militaria from the Nazi-era is focussed on not publicly showing these and especially not in conjunction with political statements.

 

In general this does not affect what you do at home, or when playing on a server.

 

Where you may want to consider being a bit cautious is online streaming, posting pictures and videos that show symbols related to the Third Reich like the swastika, SS-Runes etc.

The Iron Cross or normal plane markings are OK.

 

Even then, it is unlikely to get any legal problems, especially considering the fact that computer games are usually considered art, but some people may "feel offended" or just use the opportunity to cause you trouble... :dunno:

Alte Zeichen in neuer Zeit zu verwenden führt zu den gleichen Denkmustern!

Deswegen wurden diese Zeichen in Deutschland verboten und gehören genauso in allen anderen Ländern verboten.

Das war in keinster Weise der Punkt dieser Diskussion und gehört hier nicht her.

Die Frage war: macht er sich strafbar wenn er auf dem XY-Server ein Mod installieren muss, damit die Maschinen so aussehen wie in jedem Luftfahrtmuseum (übrigens auch in Deutschland) und die Antwort lautet: Nein.

Just a little more on this topic, since the other questions have already been answered. :)

 

Killing Floor 2 is available on Steam in Germany, no problems at all.

 

However, in some cases games are sort of self-censored or "cut" by the Publisher/Developer for the German market, meaning that there's an uncut international version and a "violence reduced" version for the German market. This way, the German version can get something like a 16+ rating, whereas the uncut game might get unrated in Germany, and the Publisher would not be allowed to advertise it and stores could not put it on display (but could still sell it "under the counter" if adult customers specifically ask for it). The same holds true for versions with/without banned symbols.

 

In earlier times, we could just order the uncut version from countries like Austria that don't have the same type of legislation that we do, and that would be perfectly legal.

 

Nowadays, many games require Steam or other online services for activation, and if they detect that the game is to be activated in Germany or with a German account, players might be forced to get the violence reduced version. In some cases, violence reduced goes hand in hand with German language only, so we can't even play the English language version (or French or Italian or whatever).

 

The only good news is that Steam, at least, displays an orange disclaimer that says something like "Violence reduced version" or "English language not supported" so that we at least know in advance that this is a cut and censored version.

 

Personally, I consider myself a grown up and would like to decide for myself which version of a game I purchase and install, and whether or not Wolfenstein should include the swastika symbol (the hero is fighting against the Nazis, after all). Unfortunately, my votes weren't able to elect a party that would finally stop this nonsensical way of moral domination over my habits. And honestly, I don't even know if my preferred parties would do away with this crap anyway. But with our current and soon to be government, chances are like one in a million that we'll see a change to the better. :(

 

The good news is that some of the most gory games have finally been removed from the "index" and Moonstone, which I played, loved and enjoyed as a teenager can finally be sold and marketed again. Seems that my generation didn't turn out mass murdering homicidal maniacs despite terrible influences like this one. :)

Es kommt immer auf den Kontext drauf an. Oder soll etwa ein öffentliches Museum, dass eine Ausstellung über das 3. Reich macht etwa alle Hakenkreuze von seinen Exponaten entfernen? Dass diese Symbole nicht dazu verwendet werden dürfen um die damit verbundene Ideologie zu propagieren ist richtig und wichtig, aber es gibt halt eben auch andere Verwendungen wie die Kunst oder die historische Darstellung und Auseinandersetzung mit dem Thema.

Auch auf die Gefahr hin, dass es hier schnell in Richtung Offtopic geht - Symbole des 3. Reiches sind nicht immer Verboten, sonder die Interaction mit ihnen (wie bei Spielen) - zum Beispiel darfst du nicht mit einem T-Shirt rumlaufen auf den ein einem Svastica ist. Aber du kannst mit einem T-Shirt rumlaufen, wo z.B. ein Svastica in den Müll geworfen wird oder wo es durchgestrichen wird!

 

Und auch in Filmen kann es benutzt werde - wie QuiGon schon schrieb, in der Kunst.

Verbiete mal Buddhisten ihr religiöses Glückssymbol!

Dieses Symbol kann in anderen Kulturen/Religionen/was auch immer, für ganz andere Sachen stehen.

Kurzes Update: Die USK hat ihre Haltung gegenüber verfassungsfeindlichen Symbolen in Videospielen soeben geändert. Ab sofort werden Spiele die solche Symbole enthalten von der USK zur Altersprüfung angenommen (das war zuvor nicht der Fall). Sie werden nun (genauso wie z.B. auch Filme die derartige Symbole enthalten) entsprechend freigegeben, solange die Verwendung dieser Symbole im Spiel nicht der Verherrlichung der entsprechenden Ideologien, sondern der Wissenschaft und Lehre, der Kunst, der Berichterstattung über Vorgänge des Zeitgeschehens oder der Geschichte oder ähnlichen Zwecken dient (sogenannte Sozialadäquanzklausel). Konkret geändert hat sich hier jetzt nicht die Rechtslage, sondern die Rechtsauffassung der zuständigen Obersten Landesjugendbehörde.
